DAYBREAK TUTORING – TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before using the website operated by Daybreak Tutoring ("we," "us," or "our") or purchasing our MCAT tutoring services.

By purchasing tutoring sessions, scheduling appointments through our website or Acuity Scheduling, or checking the "I agree to the Terms of Service" box, you ("Client," "you," or "Student") agree to be bound by these Terms. If you do not agree to these Terms, you may not purchase or use our services.


1. Scope of MCAT Tutoring Services

  • Educational Support Only: Daybreak Tutoring provides conceptual instruction, strategy review, and test-taking guidance specifically for the Medical College Admission Test (MCAT).
  • Academic Integrity: Our tutors will explain concepts, review practice problems, and guide your study plan. Tutors will absolutely not complete assignments, write application essays, or take exams on behalf of the Student.
  • Materials Excluded: Unless explicitly stated in writing, the cost of official MCAT practice materials (such as AAMC question bundles, full-length practice tests, or third-party question banks) is not included in our fees. The Client is responsible for purchasing their own study materials.

2. No Guarantees of Performance or Outcomes

  • No Score Guarantees: Daybreak Tutoring makes no guarantees, warranties, or promises regarding specific MCAT scores, score increases, percentile rankings, or acceptance into medical school.
  • Individual Results Vary: The MCAT is a highly rigorous exam. Ultimate performance depends entirely on the Student’s baseline skills, dedication, independent study hours, testing conditions, and individual aptitude.
  • Test Representation: Daybreak Tutoring is an independent preparation service. We are not affiliated with, endorsed by, or associated with the Association of American Medical Colleges (AAMC).

3. Payment, Billing, and Subscriptions

  • Advance Payment: Payment for all single sessions, session packages, or monthly subscriptions must be made in full through our integrated payment processor via Acuity Scheduling prior to booking.
  • Package Expiration: All multi-session packages must be used within twelve (12) months from the date of purchase. Any unused sessions remaining after this period are automatically forfeited and non-refundable.
  • Subscription Renewal: If you enroll in a recurring monthly tutoring plan, your payment method will be automatically charged each month until you cancel. You may cancel your subscription at any time through your client portal at least five (5) days prior to your next billing date.

4. Cancellation, Late Arrival, and No-Show Policy

Because our tutors reserve specific time blocks for individual students, we enforce a strict scheduling policy:

  • 24-Hour Cancellation Notice: You must cancel or reschedule an appointment through Acuity Scheduling at least 24 hours before the scheduled start time.
  • Late Cancellations & No-Shows: If you cancel with less than 24 hours' notice, or fail to show up within fifteen (15) minutes of the scheduled start time, the session will be considered a "No-Show." No-show sessions are forfeited and will be billed at the full session rate. No make-up sessions or refunds will be issued.
  • Late Arrivals: If you arrive late to a session, the session will still end at its originally scheduled time. The tutor is not obligated to extend the session to compensate for lost time.

5. Refund Policy

  • All Sales Are Final: Except as explicitly provided herein, all sales of single sessions, packages, and subscriptions are non-refundable.
  • Unused Sessions: Refunds are not granted for unused package sessions or unexpected changes in your MCAT study timeline. We highly recommend purchasing smaller session blocks if your test date is uncertain.
  • Tutor Issues: In the rare event that a Daybreak Tutoring tutor must cancel a session, we will provide a full make-up credit or reschedule the session at a mutually convenient time.

6. Limitation of Liability

  • Financial Cap: To the maximum extent permitted by applicable law, the total liability of Daybreak Tutoring, its owners, employees, and independent contractors for any claims, losses, damages, or liabilities arising out of or related to our services shall be strictly limited to the total amount actually paid by the Client to Daybreak Tutoring for the specific services in dispute.
  • Exclusion of Indirect Damages: Daybreak Tutoring shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost medical school tuition, lost wages, test registration fees, or emotional distress.

7. Code of Conduct and Termination

  • Mutual Respect: Clients and students are expected to treat tutors with professional courtesy and respect.
  • Right to Terminate: Daybreak Tutoring reserves the right to immediately terminate services and cancel outstanding sessions without a refund if a student exhibits abusive, harassing, inappropriate, or dishonest behavior.

8. Governing Law

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal actions or proceedings arising under these Terms must be brought exclusively in the courts located in Williamson County, Texas.
